Congress is once again seeking to end mandatory arbitration in all contexts - unless of course you are a broker or a brokerage firm. This will set up the situation where customers are able to decide whether to arbitrate a dispute, and brokers and firms will have no choice. Of course, this goes against the basic concept of arbitration, where all parties have the right to decide whether to arbitrate a dispute or not. The SIFMA has put together a complete analysis of the issue. [This message has been edited by Mark Astarita (edited 10-27-2007).] IP: Logged |
